SERVICE CONTRACT, MEMBER LIMIT OF LIABILITY &

HOLD BLAMELESS AGREEMENT

Terms used: The purchaser shall be hereafter be called the "Member". 
Be Blessed, Inc., Fundingalt.com, the Home Maintenance Program, the administrating non-profit, subsidiaries and affiliates shall hereafter be called the "Service".

BY SIGNING UP AS A MEMBER, I AGREE TO THE FOLLOWING TERMS:

RELATIONSHIPS:

The member is a member of a cooperative association comprised of BUSINESSES AND BUSINESS OWNERS, ENTREPRENEURS AND ORGANIZATIONS who have agreed to form together for the purposes of reducing and / or sharing costs of maintenance for their respective properties and facilities. 

The Service is a referral and management agency operated by a non-profit organization, namely: The Sheepfold Pentecostal Church, Inc., as a community outreach, compassion service, and fundraising venue.  The Service is also part of a network of non-profit organizations who administer the program within their respective jurisdictions or service areas, all of whom derive fundraising revenue from member contributions to this program overall.

The services provided Members are performed by independent contractors who have agreed to provide a percentage of their services as a donation to the service agency knowing that each member is contributing financially to the service agency for the work performance of said contractor.

Any services outside or in addition to your service level requested by you to the service or the service contractor constitutes a direct obligation with that contractor for which you agree to incur additional costs as agreed upon between you (Member) and the contractor.  The Service is not responsible for any work or service provided to the Member outside the service level of said Member and said Member is directly liable in addition to any liability under this contract, to the service contractor.

Both the Member and all service contractors whom engage in extra service requests and contract fulfillment, agree to make all payments through the Service solely with the Service retaining the right to assign the contractor as the receiver of any specific payment upon notification in writing from the Service directly.  Any breach of this arrangement will result in the incursion of liability, in full, of the industry standard contractor fee amount  for said extra work on both the Member AND THE Contractor.

This relationship is what justifies the terms of this agreement to which all members and contractors must agree to in order to participate in the program.        

LIMIT OF LIABILITY:

The member is not responsible for any injury incurred by any service contractor in the performance of his or her duties by the direct performance of such duty or in the operation of equipment owned and operated by the service and said contractor. 

The member assumes liability only in the event that an accident or injury should occur where the member's negligence is the cause, directly or indirectly, of the accident or injury.  This includes pre-existent conditions or conditions exacerbated, or even created, by the service contractor's performance of duties since the contractor, in good faith, is performing under the direction and imperatives of the service agreement between service and member.  Where the performance of duty is extended beyond the service level usually granted for said member, the member assumes total liability for any and all accidents or damages that may occur. 

Since the service agency is providing these services as a community outreach and help, the member agrees that in no way is the service to be held liable for any and all damages, injuries or even death, nor issues of regulations, laws or codes that the service or its contractor may be brought into conflict with by way of the member's service agreement or plan and its performance and execution.  It is the member's total and full responsibility to ensure that service contractors perform under the authority of local code and regulations that may have jurisdiction over the MEMBER's right to operate, transact business, market, or perform any and all other business functions related or not-related to the exercise of commerce and the pursuit of business or economic goals.     

Because of this gesture of community cooperation and compassion in offering this valuable service to me, I agree further:

I agree to hold the Service and any and all organizations, associations, incorporations and persons associated in any way, blameless and free from all legal obligations and claims for any losses both perceived and real that may result from or be perceived and or considered to be a derivative of any performance or lack thereof, either directly or indirectly, at any time during and after services are rendered.

The MEMBER hereby agrees to release and hold harmless the service, its contractors and agents, from all claims, loss, liability or expense (including attorney’s fees) arising from business failure, financial losses, unachieved business outcomes, unattained sales goals or quotas, lawsuits or other litigation that may arise directly or indirectly from actions performed by the service, its contractors, agents, organizations, associations, incorporations and persons having any relation with the Service and from bodily injury, property damage or death to any person or persons resulting directly or indirectly for the provision of services under this Contract.  No action of any kind relating to provision of services under this Contract shall be instituted against the Service, its contractors or agents more than one year from the date of the alleged injury, tort or breach of contractual obligation.

All the above cannot be construed as allowing for any reason to make any claim against the Service, and or persons, contractors, entities, organizations, associations, corporations, real property and or assets, related directly or indirectly to any one or all of them.

I have of my own free will and with full knowledge and understanding, request this service.

And having read and understood this agreement have, by virtue of subscribing to the Service by way of Registration and Payment of my first month's contribution, therewith cause my electronic seal to be affixed being of full mind and body and under no duress or emotional stress of any kind.
